Legal Steps to Getting Married in Scotland

Getting legally married in Scotland is straightforward once you know the steps. This guide walks you through everything you need — from the M10 forms to collecting your Marriage Schedule — in clear, simple language. Whether you live in Scotland or are travelling here to marry, these are the legal requirements for every couple.

 

Check You’re Eligible to Marry

You can marry in Scotland if you’re both 16 or over, not already married or in a civil partnership, not closely related, and legally free to marry. These rules apply to residents and visitors.

Complete Your M10 Forms

Each partner must complete an M10 Marriage Notice form. Submit them no earlier than 90 days before your date and no later than 29 days before. We recommend 10–12 weeks before.

Gather Your Documents

You’ll need original documents such as your birth certificate, passport, proof of address, and any divorce or death certificates if previously married. Some nationalities require a Certificate of No Impediment.  If you’re unsure what you need, the registrar can advise.

Pay the Registrar’s Fees

There are statutory fees for lodging your forms, registering your marriage, and issuing your schedule. These vary slightly by council but are usually around £100.

Registrar Approval

The registrar checks your forms, documents, venue, and celebrant details. They’ll contact you if anything is missing. Once approved, they prepare your Marriage Schedule.

Collect Your Marriage Schedule

You must collect this in person in the 7 days before your wedding - without it, your marriage cannot take place. 

Sign During the Ceremony

You, your partner, and two witnesses aged 16+ sign the Marriage Schedule during your ceremony. Your celebrant ensures the legal wording is included.

Return the Schedule

The signed schedule must be returned to the registrar within 3 days so your marriage can be officially registered. You can return it yourselves or ask someone you trust.
